WASHINGTON, DC — The U.S. District Court has vacated the “Delay Notice” of
the proposed Boiler MACT Rules. In announcing the decision against the
Environmental Protection Agency, Judge Paul Friedman gave his opinion that
the Delay Notice was “arbitrary and capricious.” <<
